General Terms and Conditions (AGB)

1. scope of application

These General Terms and Conditions apply in accordance with §§ 305 ff. German Civil Code (BGB) for all services provided by Soul & Bodywork – Jessica Luckas, in particular for yoga classes, individual lessons, massages, holistic bodywork, workshops, company programs, online offers and retreats.

With your booking you agree to these conditions.

2. conclusion of contract

A contract within the meaning of §§ 145 ff. BGB is concluded as soon as you book a service via the booking system, by email, by WhatsApp, by telephone or in person and the booking is confirmed by Soul & Bodywork.
Every booking is binding and obliges you to pay the agreed fee.
You will receive a confirmation by email or WhatsApp after booking. This also serves as a request for payment.

All offers are aimed exclusively at persons of legal age. Minors require the consent of a parent or guardian.

3. participation & health

Participation is at your own risk. A stable state of health is required.
Please inform us in advance of any physical or mental limitations, acute illnesses or pregnancy.

Our offers do not replace medical, physiotherapeutic or psychotherapeutic treatment within the meaning of the Heilpraktikergesetz (HeilprG). Each participant is responsible for their own physical and mental resilience.

Please also inform us of any allergies or intolerances (e.g. to massage oils/essential oils or ingredients) before your appointment so that we can prepare the treatment accordingly.

For home visits, the customer is responsible for providing a suitable environment. A safe, clean and quiet atmosphere is a prerequisite for carrying out the treatment.

During the courses and programs, it is not possible to address the personal, psychological or emotional processes of individual participants. Our offers serve to promote relaxation, awareness and well-being – not medical or psychotherapeutic treatment.

4. prices & terms of payment

All prices listed are final prices within the meaning of the small business regulation pursuant to Section 19 of the German Value-Added Tax Act (UStG)—no value-added tax is shown. Payment is due at the time of booking, unless otherwise agreed. Payment is made by bank transfer or via the payment methods offered in the booking system. If payment is not made within the specified period, the customer will be in default pursuant to § 286 BGB without further notice.

The individually agreed conditions apply to company bookings.

5 Withdrawal & Cancellation

Massages, Private Lessons & Holistic Bodywork Once you schedule an appointment, the booked time slot is reserved for you. You may cancel free of charge up to 72 hours (3 days) before the appointment.

In the event of late cancellation or no-show, the full amount will be charged.
Delays shorten the booked time; an extension or make-up is not possible.

This regulation is based on § 615 BGB (remuneration in the event of default of acceptance by the customer).

Gift Certificates

Gift certificates are valid for 365 days from the date of purchase.
Cash payouts are not permitted.
Vouchers are transferable unless otherwise agreed.
For appointments booked with a gift certificate, the same cancellation policy applies as for regular bookings.
If an appointment is forfeited due to a failure to cancel in a timely manner or a no-show, the gift certificate will be considered redeemed for the amount of the booked service.

Yoga Classes & Workshops
By booking a class or workshop, you are making a binding reservation.
The class fee is due immediately upon registration.

Since these are time-specific services within the meaning of Section 312g(2)(9) of the German Civil Code (BGB), there is no right of withdrawal or cancellation. Refunds—including partial refunds—are not permitted under any circumstances, regardless of personal, health-related, or private reasons. However, you may designate a substitute to take your place, provided they meet the conditions of participation.

Absences During the Course
If you miss a session, you have two options:
– You can designate a substitute for the missed session.
– Missed sessions can be made up—provided space is available—in a parallel course during the current course.
There is no guarantee that you will be able to make up a missed session.

Online Courses and Digital Offerings
Participation in online courses and digital offerings is at your own risk.
Technical issues on the part of participants (e.g., internet or device problems) do not entitle you to a refund.

Retreats
The following cancellation policy applies to retreats:
– Up to 120 days before the start date: Refund minus a 20% processing fee
– 119–91 days before the start date: 50% of the total amount
– 90 days or less before the start date: No refund available

It is possible to transfer the place to a substitute person, provided that this person fulfills the conditions of participation.

The retreat may be postponed or canceled in the event of unforeseeable circumstances (e.g. natural disasters, political unrest, pandemics, flight cancellations). In this case, an alternative date will be offered; a refund is excluded if the service can be made up for at a later date.

Corporate Wellness Programs
– Cancellation up to 14 days before the appointment: free of charge
– 13–8 days before the appointment: 50% of the agreed-upon amount
– 7 days or less before the appointment: full charge

Long-term company programs are considered individual service contracts and cannot be canceled after conclusion of the contract (§ 620 BGB).

6. liability

Soul & Bodywork – Jessica Luckas is liable under Section 276 of the German Civil Code (BGB) only for willful misconduct and gross negligence. Liability for slight negligence—particularly in the event of accidents, adverse health reactions, or loss of valuables—is excluded. Liability under the Product Liability Act (ProdHaftG) or in cases of injury to life, limb, or health pursuant to Section 823 of the German Civil Code (BGB) remains unaffected. Participation in all services is at your own risk.

7. photo, video & sound recordings

Photos or videos may be taken during events, classes, or retreats. These may be used for Soul & Bodywork’s public relations and social media communications. If you do not wish to be photographed or filmed, please notify us in writing before the event begins.

No recordings are made during massages and individual lessons.

8. Privacy Policy

All personal data is processed confidentially and in accordance with applicable data protection regulations, in particular the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG).

9. changes to services or dates

Soul & Bodywork reserves the right to adjust or reschedule appointments or content for organizational or health-related reasons (e.g., illness, force majeure, or insufficient number of participants). In such cases, an alternative date will be offered if possible, or a qualified substitute will be provided. If neither is possible, the amount paid will be credited.
Any further claims are excluded.

10. changes to the conditions of participation

Soul & Bodywork may amend these GTC if necessary. The current version is available on the website. Changes only apply to future bookings; bookings that have already been confirmed remain unaffected.

11. final provisions

Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected (Section 306 BGB).
The law of the Federal Republic of Germany shall apply (Art. 3 EGBGB).
